Terms and Conditions

§ 1 Scope and contracting parties

(1) These General Terms and Conditions (Terms) apply to all contracts for services provided by Rosalia Energy Place, owner Rosalia Cunetto, Engelbergstraße 8, 70839 Gerlingen, Germany (“Rosalia Energy Place”), to its clients. Clients may be consumers (e.g. athletes, private individuals, animal owners) or businesses (e.g. managers, agencies, clubs, teams, companies).

(2) The contracting party and invoice recipient is the person or organisation that places the binding order for the service. If a manager, agency, club or company books a service for another person, such as an athlete, the party placing the order is liable for payment.

(3) Deviating terms of the client only apply if Rosalia Energy Place expressly agrees to them in writing.

(4) Individually negotiated agreements take precedence over these Terms.

§ 2 Services

(1) Rosalia Energy Place offers energetic support for relaxation, recovery, body awareness, mental focus and personal development – for athletes, teams, private individuals and animals. Sessions take place in person or remotely by telephone. The type, duration and price of the service are set out in the appointment confirmation and the price list on this website.

(2) The services do not constitute and do not replace medical, physiotherapeutic, psychotherapeutic, other healthcare or veterinary diagnosis or treatment. No promises of healing are made. No particular health, sporting or other result is owed or guaranteed.

§ 3 Individual support, competition support and teams

(1) In addition to single sessions and packages, Rosalia Energy Place offers individually tailored support, in particular monthly support (Elite Athlete Support), on-site support at competitions (Competition Support) and services for teams, clubs, companies and management.

(2) A separate written support agreement is concluded for these services, setting out in particular the type, scope, duration, fee, travel costs and any special cancellation rules. These Terms apply in addition.

(3) Statutory rights of withdrawal and termination and other mandatory consumer rights remain unaffected.

§ 4 Booking and conclusion of contract

(1) The presentation of services on this website is not a binding offer. Appointments are arranged by telephone.

(2) The contract is concluded when the service and appointment are bindingly agreed by telephone. Rosalia Energy Place then confirms the appointment in text form via WhatsApp, SMS or email, stating the service, price and, where applicable, travel and cancellation terms, together with a reference to these Terms and the withdrawal information.

(3) Agreed appointments are reserved for the client on a binding basis.

§ 5 Minors

(1) Minors are only supported with the prior express consent of a parent or legal guardian. The contract is concluded with the parent or legal guardian or with the party placing the order.

(2) If required, the session takes place in the presence of a parent.

§ 6 Prices and payment

(1) The prices stated when the appointment is arranged apply. Rosalia Energy Place is a small business within the meaning of § 19 of the German VAT Act (UStG); therefore no VAT is charged or shown.

(2) Payment in advance applies. Single sessions must be paid before the appointment. Packages of 3 or 5 sessions must be paid in full before the first appointment. Monthly support must be paid in advance for each billing period.

(3) Payment can be made in cash, by bank transfer or via PayPal. A bank transfer must be received before the appointment; cash payment is possible at the latest at the start of the appointment.

(4) No sessions take place until payment has been made in full. Appointments already reserved may be released after prior notice in text form. Outstanding amounts are reminded in writing.

§ 7 Packages

(1) Packages of 3 or 5 sessions are valid for three months from the date of purchase. Sessions not used within this period expire; unused sessions are not refunded. If Rosalia Energy Place was unable to offer appointments within the validity period for reasons for which it is responsible, the validity is extended accordingly.

(2) A package may only be transferred to another person after prior agreement with Rosalia Energy Place.

§ 8 Cancellation, rescheduling and late arrival by the client

(1) Appointments can be cancelled or rescheduled free of charge up to 48 hours before the start, by telephone or in text form.

(2) In the event of a later cancellation or if the client does not attend, the claim to the agreed fee remains; for packages, one session is deducted. Rosalia Energy Place must offset any expenses saved as a result of the cancellation or any income earned by reallocating the appointment.

(3) In the case of verifiable illness or injury, a goodwill solution may be offered by agreement.

(4) If the client arrives late, the session will be extended accordingly where possible. If this is not possible, the session ends at the agreed time; the agreed fee remains payable in full.

(5) Mandatory statutory rights, in particular the consumer right of withdrawal, remain unaffected.

§ 9 Cancellation by Rosalia Energy Place

(1) If Rosalia Energy Place has to cancel an appointment, for example due to illness, it will inform the client as early as possible and offer an alternative appointment.

(2) If no alternative appointment is arranged, any amounts already paid for this appointment will be refunded. Further claims are governed by § 14.

§ 10 Remote sessions

(1) Remote sessions take place by telephone. The client ensures that they can be reached at the agreed time and are in a quiet environment.

(2) If the connection cannot be established for technical reasons on the client’s side, a new appointment will be arranged at no extra cost.

§ 11 On-site appointments, travel and travel expenses

(1) For appointments outside a radius of 15 km around Gerlingen, travel costs may be charged. The costs confirmed in advance in text form are decisive.

(2) For journeys by car, a mileage allowance is agreed in advance, usually €0.50 per kilometre driven for the outward and return journey. Train, flight, hotel and other necessary expenses are charged at actual cost after the client’s prior consent. Travel time is not charged.

(3) If the client cancels an on-site appointment, the client bears the travel costs agreed with them that have already been incurred and cannot be cancelled, unless Rosalia Energy Place is responsible for the cancellation.

(4) A cancellation fee for days kept free, for example for competition support, is only charged if it is set out in a separate written agreement.

§ 12 Monthly support

(1) Monthly support has no minimum term. It is paid one month in advance.

(2) The client may terminate monthly support at any time with effect from the end of the current billing month by notice in text form. The right to terminate for good cause and other statutory termination rights remain unaffected.

§ 13 Health, client cooperation and animals

(1) Before the first session, the client informs Rosalia Energy Place of any significant health restrictions, injuries and ongoing medical treatment insofar as they may be relevant to the session.

(2) The client undertakes not to discontinue or postpone ongoing medical or therapeutic treatment because of the sessions and to seek medical advice in the event of complaints.

(3) A session will not take place if, in the case of recognisable complaints, a necessary medical assessment or medical report is missing, or if the client is impaired by alcohol, cannabis or other drugs. In the case of fever, acute illness, a marked feeling of illness or acute injury, a session will only take place after prior clarification and, if necessary, medical clearance.

(4) For animals, the service does not replace a veterinarian or veterinary diagnosis or treatment. The animal owner remains responsible for the health, safety and care of the animal.

§ 14 Liability

(1) Rosalia Energy Place is liable without limitation for intent and gross negligence, for injury to life, body or health and in accordance with mandatory statutory provisions.

(2) In the case of slight negligence, Rosalia Energy Place is only liable for the breach of essential contractual obligations, i.e. obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the client may regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract.

(3) Otherwise, liability is excluded. These provisions also apply in favour of vicarious agents.

§ 15 Confidentiality and recordings

(1) Rosalia Energy Place treats all information from the collaboration confidentially, including the fact that a collaboration exists. Clients are only named as references with their express consent. Statutory disclosure obligations remain unaffected.

(2) Photo, audio and video recordings during a session are only permitted after prior agreement.

§ 16 Data protection

Information on the processing of personal data can be found in the privacy policy.

§ 17 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

(2) If the client is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the registered place of business of Rosalia Energy Place.

(3) The language of the contract is German. Translations of these Terms are for information purposes only.

(4) Should individual provisions of these Terms be invalid, the remainder of the contract remains valid.

Withdrawal information for consumers

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Rosalia Energy Place, Rosalia Cunetto, Engelbergstraße 8, 70839 Gerlingen, Germany, phone: +49 152 27674430, email: rosaliacunetto@icloud.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
